Dear Sir/Madam
We are members of XL Results Foundation Pte Ltd for which we pay a fee of USD$XXXXXXX for a life membership.
We would like to make a complaint against XL Results Foundation Pte Ltd, Singapore for the following reasons
- Misrepresenting members using the name FOUNDATION as a private business concern.
- Does the company hold a trust fund in Singapore to protect life membership monies? We purchased a life membership where are the funds?
- Misrepresentation regarding the Master Coach Dave Rogers ability. Dave Rogers is not accredited or qualified.
- No proof of the 10% charitable donations taken from each life memberships in Singapore and the region as promised verbally and in writing by Roger Hamilton has been forthcoming. Repeated requests for receipts, donations and amounts have not been forthcoming.
- The Terms & Conditions keep changing without fair notification to life members.
- No cooling off period or refund policy implemented by the company.
- Roger Hamilton has openly misrepresented members about his business experience and his educational qualifications.
- High pressure sales tactics and misrepresenting members on the number of memberships available. The MTI gazette three day cooling off period is not honored.
Also, the following list of services that warrant our membership entitlements are not delivered.
a) The XL Results Foundation coaching is of poor quality, not certified, accredited or recognized with anyone. XL is not affiliated with the International Coaching Federation in the US.
b) Misrepresented about the extent of the XL Results Foundation network. The XL network consists mainly of the free linkedin and ecademy network. Ecademy only has 8,000 paid subscribers world-wide. Members have been misrepresented about XL network numbers which have not been substantiated.
Singapore is reputed to be a safe and honest business enterprise. We do not understand how this predatory business: XL Results Foundation’s can operate in Singapore.
We ask the Consumer Affairs Department to look into the unfair business conduct of Roger Hamilton and Dave Rogers of XL Results Foundation and find out where our life membership funds are and where are the reserves to guarantee life membership.
Yours faithfully

Dave Rogers: Head Coach of XL Results Foundation, CEO Ecademy Asia Pacific
Roger Hamilton - Chairman of Ecademy Asia Pacific
I just read the news today as it was forwarded to me by one of my contacts on Linkedin. It looks really bad and does cast a black shadow over the integrity of ecademy and Thomas Power as Thomas has given Roger a platform to promote his dishonesty for a number of years now.
It is sad to hear about this and I was informed by an ex employee of Rogers who told me that he promised to give to charity and pocketed the funds for himself.
I am in the process of setting up Marzar a social media platform for businesses and professionals and I can tell you Mr Hamilton and Mr Rogers that you will not be welcome.

I resigned my Directorship of Ecademy in 2004.
I remain a 15% shareholder of the Company that owns Ecademy
(Routecause Limited)
I remain convinced that Ecademy has tremendous value for its subscribers.
I know that Ecademy produces an incredible income for its Directors.
Sadly they leave nothing left for its shareholders. Minimal declared annual profits and carry forward losses ensure that there is no dividend available for shareholders!
Over the last two years, I have asked the Directors many shareholder questions but have been met with evasion at every juncture. I have told them that I do not beleive that the directors are creating any value for its shareholders … only for themselves …
They have neither done nor said anything that convinces me otherwise.
I am disenchanted with Thomas Power, Penny Power and their fellow director, Glenn Watkins, but I will not accuse any of them of doing anything illegal.
Being greedy would be a more more appropriate description.

I for one appreciate your candour and will be interested to see how they spin your comments here to reflect them in a positive light.

I suspect that there will be either silence - or a letter from their legal people to me. These are the options they usually exercise.
But then again, they may actually start to take notice of the criticism they are receiving currently and revise their behaviour.
On the other hand…. Duck for cover… here comes another low flying pig.
July 15, 2007 at 4:11 pm
And unfortunately they are very unlikely to attract a trade buyer with their extravagant ways either.
On what basis could they threaten legal action? The truth is not libelous and they are self evidently greedy. They may not be aware of it but any Director has a duty of fiduciary care to the company of which they are directors, this means they must always act in the best interests of the shareholders and the company’s long term benefit in all decisions they make.

I would suspect that were this to be tested in a court of law they would be found to have been lacking in this regard.

David,
Your observation regarding “Duty to shareholders” is correct. I have had Corporate legal advice on the lack of care being shown to shareholders and the conclusion was that, under the Companies Act, The Directors are, quote, “Acting in a manner prejudicial to the interests of its shareholders”.
Unfortunately, to mount a suit would cost much more than I have at my disposal, otherwise I would certainly launch one.

XL Foundation Pyramid Scheme
http://xlresultsfoundationscam.blogspot.com/
XL Results Foundation - Pyramid Scheme
Asia Pacific Community join forces to expose pyramid scheme.
How do I recognise a pyramid scheme: Ministry of Trade and Industry Website: http://www.mti.gov.sg defines a pyramid scheme as follows:
Many pyramid schemes often disguise themselves as sellers, collectors items, software, training programmes, etc. When all they are really interested in is to make a quick buck through recruitment. Members of the public who attend sales talks must be vigilant to such schemes. Illegitimate MLM schemes usually share the following characteristics:
When the promoter hype about how easy it is to earn money, people can get rich in a very short time and that the way to earn money is by recruiting others to join the scheme.
The so called product that you are supposed to sell is not something you would normally buy at its price.
Participants are required to invest money into the scheme whether in the form of a joining fee or buying inventory.
How do I lodge a complaint against a pyramid scheme. Refer to website http://www.cad.gov.sg

Dear Sir
RE: Pyramid Schemes - Scams/frauds Targeting Members of the Public
I wish to file a complaint against a Singapore Company XL Results Foundation Pte Ltd (Company registration: 200107729C).
I believe the Director, Mr Roger Hamilton is operating a pyramid scheme targeting members of the public.
The company’s revenue source is from the recruitment of membership sales into its global business network 丒XL Results Foundation Pte Ltd.
I refer to the CAD website http://www.cad.gov.sg - The Illegal Pyramid Selling Scheme: “pyramid selling scheme or arrangement” means any scheme or arrangement for the distribution or the purported distribution of a commodity whereby:
(a) a person may in any manner acquire a commodity or a right or a licence to acquire the commodity for sale, lease, licence or other distribution;
(b) that person receives any benefit, directly or indirectly, as a result of 丒
(i) the recruitment, acquisition, action or performance of one or more additional participants in the scheme or arrangement; or
(ii) the sale, lease, licence or other distribution of the commodity by one or more additional participants in the scheme or arrangement; and
(c) any benefit is or may be received by any other person who promotes, or participates in, the scheme or arrangement (other than a person referred to in paragraph (a) or an additional participant referred to in paragraph (b)).
I believe Roger Hamilton and XL Results Foundation Pte Ltd in Singapore is scamming members of our community and operating an illegal business.
XL Results Foundation is promoting itself as a charitable organization to deceive the community. This is a ploy to recruit new members into the scheme.
The company has faced a community petition in Asia Pacific with more than forty complaints lodged against the company in one day as reported by the Straits Times Newspaper. It is believed several hundred members have also demanded their membership payment refunded claiming they were duped. A copy of the original petition can be found on http://rogerhamiltonexposed.wordpress.com
To pay off these current disgruntled members Roger Hamilton expands into a new market (Ponzi scheme) and sells to newly duped members who are unaware of the petition and press scrutiny. The company has just announced plans to expand into Canada and Mexico.
In the past six months XL Results Foundation has been featured negatively in several newspapers including: The Straits Times - Singapore (23/10/06 & 25/11/06), The Today Newspaper - Singapore and The Courier Mail - Australia (24/02/07). Duped members of the Singapore community have also spoken out against the company on English and Chinese Radio Stations in Singapore including Radio 93.8. (To view these articles refer to website: http://rogerhamilton-consumerwatch.blogspot.com)
The most recent article appeared in the online edition of the Brisbane Times in Australia (May 30, 2007) under the caption “Suspect wealth creation network in Brisbane” refer to the link below for full details.
http://www.brisbanetimes.com.au/articles/2007/05/30/1180205312469.html
It is obvious this company is operating a scam.
I ask the officers of the Commercial Affairs Department to look into the business conduct of Roger Hamilton and XL Results Foundation and obtain detailed accounts to establish the revenue source of XL Results Foundation Pte Ltd.
The local and international community has a right to be protected from this individual and company.
Yours faithfully

Until today I was a supporter of XL and Roger Hamilton.I now realise it is a fraudulent scam.In May 2007 my wife and I were were induced into purchasing an XL Cafe franchise. We were promised(and it still states on the XL website) that 24 franchises had been taken up.Actually there was a maximum of 3.Today we requested that our money be refunded and we were quickly refused. Will the Singapore authorities do anything about this?
July 30, 2007 at 10:04 pm
I now understand that another person from Dubai has the same problem as me.We both paid US$16,000.After threatening to complain XL has now said it will consider a refund. This makes me even more suspicious.I also understand that the matter of XL failing to provide receipts and accounts will go to court in Singapore on August 6 2007.I am very hopeful that I am wrong and that I will get my money back but until there is full 100% transparency by this company no one should pay them anything and everyone who has paid them anything should demand it back.
July 31, 2007 at 12:31 am
I have now received 2 lengthy emails from Roger Hamilton personally guaranteeing that both our deposits will be returned immediately.I am posting this as quickly as possible and trust that it will be placed on this site as quickly as possible.
July 31, 2007 at 12:39 am
If it helps, please feel free to post the emails from Roger.
July 31, 2007 at 6:50 am
Members of the community need to ask “Why is XL Results Foundation attempting to block the court request for full disclosure of accounts?
If you are a current life member and concerned you have been duped and your money is propping up an illegal pyramid scheme you are advised to seek independent legal advice.
Any agent or licensee of Roger Hamilton and XL Results Foundation is advised to seek independent legal advice regarding international law on pyramid schemes.
July 31, 2007 at 8:03 am
I will confirm when the money has been repaid but at present consider no problem exists with XL Results Foundation and that people should feel free to check it out and join if they think it will be beneficial for them and their goals.I have also now learnt that XL`s financial information is readily available on line.
August 1, 2007 at 5:12 am
I want the truth to come out about XL and also everyone to be happy and friendly.I can only relate my own experiences. My cafe deposit money has been refunded today with considerable speed.I still have concerns about lack of cooling off period and some recruitment methods and lack of transparency with where money is and how it is being used etc.

In the beginning there was a seed.
August 6, 2007 at 5:02 pm
Further suspicion has been raised today against XL Results Foundation, Singapore as the company successfully blocked a legal request for FULL disclosure of its company accounts.
It is a short term reprieve for XL Results Foundation as further multiple legal action by life members against the company is expected.
Life Members are asking why their membership fees are going into legal fees to block the request.? And why the full detailed accounts are not being forthcoming? Exactly what is the company hiding?
Allegations against the company include it is operating an illegal pyramid scheme duping members globally.
Any individual who has purchased a Life Membership from XL Results Foundation can lodge a complaint with the Commercial Affairs Department (Get Rich Quick Fraud Department on http://www.cad.gov.sg)
International members may also wish to lodge a copy of their complaint with the Singapore Embassy in their country of origin refer to website (Singapore Missions Worldwide under website: http://www.mfa.gov.sg)
